ST. CHARLES TOWNSHIP – A Kane County judge sentenced a “31-year-old, married child predator” to 4 1/2 years in prison after he pleaded guilty to three counts of felony aggravated criminal sexual abuse of a victim between 13 and 16 years old, according to a news release from the Kane County State’s Attorney’s Office.

Kane County Associate Judge David Kliment sentenced Tony F. DiMaio, 34, of the 109 block of Fifth Avenue, Marathon, Fla., on June 26. Di Maio also pleaded guilty on May 15 to felony indecent solicitation of a child.

Kane County State’s Attorney Joe McMahon stated in the release that, “Mr. DiMaio preyed on this child, convincing the child that he was a teenager when in truth he was a 31-year-old, married child predator.”

“It is difficult to fathom the effort he went to to have sex with a child, grooming the child online and driving to the Chicago area from south Florida,” McMahon stated in the release. “My thanks to ASA Lori Schmidt and to Aurora Police Det. Darrell Moore for their work on this case."

Kane County prosecutors stated that DiMaio had befriended the victim on Facebook, purporting himself to be 17 years old.

In November 2017, DiMaio drove from his home in Marathon, Fla., to the victim's home in Aurora and sexually abused the victim, the release stated.

The victim's parents saw DiMaio on surveillance video the next day and contacted police.

In addition to the prison term, DiMaio must register for life as a sexual offender in accordance with the Illinois Sexual Offender Registration Act.

In accordance with state law, DiMaio is eligible for day-for-day sentencing and will receive credit for 841 days he served in the Kane County jail.
